HYD User Agreement for Users in the European Region

Thank you for your interest and welcome to Hunt Your Dream!

We would like to work with you in a sincere manner and this requires that we must reciprocally observe certain rules. These rules combined represent the ‘HYD User Agreement’. You can only use our (Additional) Services if you agree with the HYD User Agreement. Hence, read this agreement carefully. You can also find our Privacy Policy in this HYD User Agreement.

Definitions

  • Additional Services: additional Services, functionalities or Content that are offered against payment and that are not available in Hunt Your Dream Free, or only to a limited degree. You can find a description of these additional functionalities in Hunt Your Dream in the Store and on the internet on our website huntyourdream.com.
  • Account: a User who registered with Hunt Your Dream by filling in and sending the registration form in Hunt Your Dream or who otherwise registered with Hunt Your Dream. Registration is mandatory to be able to use the Services and/or the Additional Services. Registration is only possible if you are at least 16 years of age. You cannot register more than once.
  • Collective Part: the part of the Services that is aimed at sharing data with the community, hence with other Users. These kinds of functionalities include the participation in the community.
  • Journal: online book in which the following is, inter alia, shown on a daily basis: the questions answered, texts and images that were uploaded by the User.
  • Services: functionalities of the Hunt Your Dream application that the Licensor offers to you and that can roughly be divided into the Personal Part and the Collective Part.
  • User / you: the user of Hunt Your Dream who has an Account.
  • Growth Topics: topics that are related to your personal development and growth. Topics that make you think about what is truly important to you in your life. The various questions assist you in becoming the best version of yourself.
  • Hunt Your Dream Free: the Hunt Your Dream application in which the Licensor offers a limited number of Services free of charge. This application has less functionalities than Hunt Your Dream Premium.
  • Hunt Your Dream Premium: the Hunt Your Dream application in which the Licensor offers Additional Services against payment.
  • Hunt Your Dream: the Hunt Your Dream by Connecting Your Love application is exploited by Winning Quotations Only B.V. and is made available in the App Store, Google Play Store and on the internet on our website huntyourdream.com. Where we refer to Hunt Your Dream - without addition - we refer to both Hunt Your Dream Free and Hunt Your Dream Premium.
  • In-App Purchases: any and all purchases that you can perform from Hunt Your Dream.
  • Content: any and all data, including but not limited to information, Content and visual material, that the User saves in Hunt Your Dream and/or shares with third parties in Hunt Your Dream.
  • Licensor / we: the private company with limited liability Winning Quotations Only B.V., having its registered office in Arnhem (the Netherlands) and registered with the Chamber of Commerce under no. 27282051, and establishment no. 000017507294, as well as all its subsidiaries, parent and sister companies and directors.
  • Moodboards: digital mood boards where the User can upload photos.
  • Personal Part: the part of the Services where you save your data for individual or personal use. These kinds of functionalities include but are not limited to the availability of personal Growth Topics, Moodboards and an online Journal that is updated (mostly or entirely) in an automated manner.
  • Store: the Apple App Store and/or the Google Play Store.
  • Support: our user support that you can, inter alia, ask questions about the use of Hunt Your Dream, the (Additional) Services and in case of problems with or the closing of your Account.
  • Universal Topics: on the basis of 12 universal topics questions are discussed here that can be presented to the User in the Collective Part and that can be answered by the Users.
  • Wall of Dreams: a feature of the Community where the User (whether or not anonymously) can show a dream using text and images. This dream is also shown outside the Community at www.huntyourdream.com/wall-of-dreams.
  • Chat: The user can ask personal questions using the chat which will be answered by Hunt Your Dream. This information is covered by Support.
  1. Licensing conditions

    1. On the condition that you shall continuously comply with the HYD User Agreement, the Licensor grants you a strictly personal, worldwide, royalty-free, non-transferable, non-exclusive, irrevocable and non-sublicensable right to use for access to and use of our Services. The user licence takes effect at the moment that you download Hunt Your Dream from the Store and install it on your (mobile) device or when you first make use of the Hunt Your Dream web application.
    2. The user licence automatically expires if: (a) your Account is deactivated or is closed, (b) if you violate one or more obligations pursuant to the HYD User Agreement.
    3. We reserve the right to, as the occasion arises, revoke your user licence and/or to close your Account, for instance if you violate the conditions pursuant to the HYD User Agreement.
    4. If you use Hunt Your Dream Premium and/or if you use In-App Purchases then the Licensor grants you a user licence for this with which you obtain access to the Additional Services of Hunt Your Dream Premium and/or the In-App Purchase. These Additional Services are, barring the below, made available on the basis of the same conditions as the Services (of Hunt Your Dream):
      1. With regard to the user licence for Hunt Your Dream Premium it is noted that it automatically expires following expiry of the subscription period.
      2. With regard to In-App Purchases it is noted that the user licence is granted for the duration as indicated in the information that is provided during the ordering process of the In-App Purchase.
  2. Services

    1. To be able to use Hunt Your Dream, the Services and the Additional Services you must create an Account. After the completion of the registration process you can log in on Hunt Your Dream with your Account as a result of which you obtain access to the functionalities.
    2. To use Hunt Your Dream you must dispose of a smart phone, tablet or other (mobile) device on which Hunt Your Dream functions via a modern internet browser. The Services and Additional Services focus on the recording of Content and, as the occasion arises, the sharing of the same with others; that is why Hunt Your Dream requires a permanent internet connection to function. You are personally responsible for the potential costs of mobile use and other data charges that are associated with the use of Hunt Your Dream.
    3. To continue making use of Hunt Your Dream you must ensure that the data with which you created an Account remain up to date. For instance, if you start using a new telephone number then you must adjust this telephone number as soon as possible. You can change registration data in Hunt Your Dream in the Settings menu.
    4. Think about the protection of your Account by selecting a strong and unique password and not to share it with third parties.
    5. If you violate one or more obligations pursuant to the HYD User Agreement then we reserve the right to, as the occasion arises, deny you access to Hunt Your Dream and/or to close your Account.
    6. If we deactivated your Account (for instance for security reasons) then you are not allowed to create a new Account.
  3. Unlawful content

    1. Hunt Your Dream offers a secure environment where you can work on personal development and growth. That is why we offer you the freedom to save Content in Hunt Your Dream. However, you must ensure that the Content that you save in Hunt Your Dream is lawful. This implies that your Content cannot be in violation of the law and/or the HYD User Agreement. It is, therefore, not allowed to save Content in Hunt Your Dream that:
      1. discriminates, is violent or slanderous, polarises or disseminates hatred;
      2. infringes (intellectual property) rights of third parties, as explained below under ‘Rights of third parties’;
      3. is of a pornographic or erotic nature (in the broadest sense of the word).
    2. We bring to your attention that it falls under your own responsibility to check Content that you save in Hunt Your Dream and/or share with third parties in advance. Users can report Content that is in violation of the law and/or the HYD User Agreement in Hunt Your Dream via the Support button. We reserve the right to remove your Content if we are of the opinion that it is in violation of the law or the HYD User Agreement. We are also allowed to remove Content in order to comply with (our) statutory obligations.
    3. It is not possible for us to screen all Content in advance. We take measures if we discover that certain Content is unlawful or if a User brings this to our attention.
  4. Paid Services

    1. The use of Hunt Your Dream Free is free of charge for the User.
    2. We offer the Hunt Your Dream Premium application against payment. In Hunt Your Dream Premium you can use Additional Services. We offer Hunt Your Dream Premium in the form of a monthly, an annual and a life-long subscription.
    3. If you purchase a monthly or annual subscription then we charge a subscription fee monthly or annually, respectively, on the date that the term of the subscription takes effect and subsequently every time on the date that the subscription is renewed (automatically). Subscriptions for a fixed period are renewed automatically by the same term after expiry of the subscription period. You acknowledge and agree that Hunt Your Dream is authorised to complete debiting of the payable amount through the same means of payment as used for the initial subscription.
    4. If you purchase a life-long subscription and/or In-App Purchase then we charge a single amount. The level of this amount is specified in the Store and on our website and you can also find this amount in Hunt Your Dream.
    5. The subscription to Hunt Your Dream Premium and In-App Purchases are linked to your Account and cannot and may not be transferred.
    6. All our prices are inclusive of VAT and other official duties. Costs for the use of the means of payment selected by you, which are charged by the payment provider, are not included in the price and are at your own expense. We offer, depending on the manner you purchase a subscription to Hunt Your Dream Premium or an In-App Purchase, various means of payment. The amount that you are liable to pay to us is charged automatically and paid by means of the payment method that you select.
    7. We reserve the right to, as the occasion arises, refuse your order for a subscription to Hunt Your Dream Premium and/or an In-App Purchase, for instance if the payment was unsuccessful, if we suspect your means of payment to be fraudulent or if there is question of other circumstances  that - exclusively at our discretion - imply that we do not want to accept your order. If we refuse your order then we shall not charge it.
    8. If the payment is unsuccessful or if we refuse your order then we shall refuse and/or deny you access to Hunt Your Dream Premium and/or In-App Purchases.
    9. We can change the price for Hunt Your Dream Premium and/or In-App Purchases. Price changes for Hunt Your Dream Premium are only processed after expiry of the subscription period. If the price of your subscription changes then Hunt Your Dream sends you, at least one month in advance, an email with information about the price change. We also display a message with information about the price change when you use Hunt Your Dream. You agree with the new price by continuing to use Hunt Your Dream Premium after the price change has taken effect.
  5. Cancellation

    1. You can cancel your subscription to Hunt Your Dream effective from the date that the subscription expires or is renewed (automatically), in consideration of a notice period of at least one month. A cancellation that we receive after expiry of the notice period is deemed to be a cancellation effective from the end of the first-following subscription period. You can easily cancel your subscription by going to your account settings in the App Store. Click on the Subscriptions button to cancel your subscription to Hunt Your Dream.
    2. Fees that have already been paid in advance remain payable despite cancellation and shall not be repaid.
  6. Updates and upgrades

    1. We feel that life itself is a continuous and dynamic process of development and growth. Hunt Your Dream assists you in becoming the best version of yourself. We try to gear our (Additional) Services to the dynamics of your life in the best way possible. That is why we are continuously working on the optimisation of our (Additional) Services and the development of new (Additional) Services. Hence, over time we add new functionalities, questions, products, etc. to Hunt Your Dream. This process of continuing development may also imply that we discontinue existing functionalities and products (with immediate effect). As the occasion arises, we try to inform you in advance, however we cannot guarantee that this always occurs.
  7. Support

    1. Do you require support during the use of our (Additional) Services, is there something that worries you, or do you have a complaint? Then contact us via the Support button in Hunt Your Dream and we shall then examine if we can solve the problem.
  8. Intellectual property rights

    1. We are the owner of any and all source codes, figurative marks, domains, logos, copyrights, trademarks, business secrets, the concept and any and all other intellectual property rights that are related to Hunt Your Dream and our (Additional) Services. This includes - but is not limited to - the methodology and the content of the questions, the Moodboards, the online Journal as well as the methodology and the concept of the answers and presentation of the Growth Topics and the Universal Topics and the cooperation from the Collective Part.
    2. It is prohibited to infringe our intellectual property rights. This implies that you cannot - without being exhaustive - use the source codes, (figurative) marks, domains, logos, copyrights, portrait rights, videos, business secrets, our concept and any and all other intellectual property rights.
    3. More specifically, it is noted that you cannot copy, mutate, distribute, sell or lease any part of the (Additional) Services. It is also prohibited, unless permitted by law, to submit our software to reverse-engineering or to otherwise try to retrieve the functioning and/or the source code of Hunt Your Dream.
    4. Any and all Content that you share on Hunt Your Dream remains your property.
    5. With regard to Content that you share in the Personal Part you grant the Licensor a licence to save the said Content in Hunt Your Dream, to show the said Content to you and to, at your express request, provide the Licensor and/or third parties insight into the said Content. This licence comes to an end at the moment that your Account is closed. The Licensor shall remove your Content in the Personal Part at the moment that your Account is closed.
    6.  With regard to any and all Content that you share via the Collective Part and/or at the request of the Licensor it is noted that you grant the Licensor a perpetual and non-cancellable licence to disclose and duplicate the said Content, both in and outside the Collective Part, for any purpose whatsoever, including - but not limited to - publication of the said Content on the internet, without you being entitled to any compensation (also after you have closed your Account). You also waive your personality rights within the meaning of the Dutch Copyrights Act. The Licensor shall always mention the name under which you posted the Content in the Collective Part and/or otherwise shared it at the request of the Licensor.
  9. Rights of third parties

    1. Hunt Your Dream gives third parties (e.g. publishers, influencers and persons with an inspiring message) the opportunity to make a substantive contribution on the basis of the Universal Topics. The intellectual property rights in respect of the said contributions are completely vested in the relevant third party. The third party grants the Licensor a licence to disclose and duplicate the contribution on Hunt Your Dream for the duration and on the basis of the conditions stipulated with the said third party. The responsibility and liability for the Content of the said publication is fully vested in the person or organisation who posted it. This does not alter the fact that Hunt Your Dream reserves the right to check any and all Content that is shown within the Services and Additional Services and to remove Content that is in violation of the law and/or the HYD User Agreement. However, because we do not screen all Content, we cannot guarantee that all Content always complies with the imposed conditions.
    2. Respecting the (intellectual property) rights of third parties also implies that as a User of Hunt Your Dream you cannot infringe (intellectual property) rights of third parties. Hence, it is prohibited to post Content that infringes copyrights, trademark rights and other (intellectual property) rights of third parties. It is equally not allowed to, in any way whatsoever, disclose and/or duplicate Content of other Users, unless the other User expressly gave consent to this. As a User you are personally responsible for that.
  10. Closing of Account

    1. We make our best effort to commit you to Hunt Your Dream for life. However, this does not alter the fact that you can remove Hunt Your Dream at any time and without stating reasons and you can close your Account. You can close your Account in Hunt Your Dream in the Settings menu or by contacting our Support. If your Account is closed, and the HYD User Agreement is consequently terminated or rescinded, then you remain bound by articles 6, 7, 9, 10, 12 and the Privacy Policy.
  11. Disclaimers

    1. The Licensor tries to offer (the Services and Additional Services of) Hunt Your Dream as securely, reliably and diligently as possible and without bothersome disruptions. We can, however, not guarantee that Hunt Your Dream always functions without hindrance and failures. This implies that you use our Services and Additional Services entirely at your own risk. Moreover, the following disclaimers are applicable. We offer our Services ‘as is’ and ‘as available’, without any express or implied guarantee, e.g. guarantees of good quality, service, marketability, suitability for a specific purpose and uninterrupted enjoyment.
    2. Nor can we guarantee that our Services and Additional Services shall always be free from viruses or other malicious software (malware). We do not guarantee that data supplied by us (including questions and articles) are error-free, complete or meaningful. We do not guarantee that our Services and Additional Services always function securely and without failures, delays or shortcomings. We do not control and are not responsible and liable for the manner that you, other Users or third parties use our Services and Additional Services. We are not responsible for and are not held to screen the actions and substantive matters of you, the other Users and third parties. And that is why we cannot guarantee that all Content and actions comply with the imposed conditions.
    3. Medical disclaimer. The information and questions in Hunt Your Dream are not intended to replace services or information provided by trained (medical) professionals and/or care organisations, such as general practitioners/physicians, medical experts, urgent care, (immediate) mental health care, physiotherapists, and psychotherapists.

The information and usage options serve to support the Self-Healing Growth Theme and cannot be considered a replacement for medical or other professional help, care, support, or provision of information. Nor are they intended as a tool for (self-)diagnosis. This means that the User cannot use assign the information a diagnostic or therapeutic value for the own medical situation or the medical situation of third parties.

The User is advised to submit medical questions, complaints, or symptoms to the treating physician or another healthcare professional in a timely fashion to receive a professional examination, diagnosis, and possible medical care. Users are recommended to never postpone seeking timely professional care and to never ignore obtained medical advice based on (online) information.

In case of immediate medical complaints or mental issues, and if complaints or symptoms worsen, the User is recommended to immediately contact his own general practitioner/physician or the emergency number.

Self-Healing Growth Theme recommendations are not medical advice. The questions contain recommendations in a number of cases. These recommendations never constitute direct medical advice and never specifically concern the individual medical situation of the User or third parties.

The recommendations must be considered general information. Even if this concerns information concerning the use of (self-care) supplements, this never concerns medical advice or information which specifically relates the individual medical situation of the User or third parties.

Medical questions. Because Hunt Your Dream never provides direct or indirect medical advice intended to replace professional medical advice, no questions of Users will be answered concerning issues or requests which, for example, concern medical/mental complaints, treatment options, or the results of certain (medical) care.

Liability. The use or application of information provided by Hunt Your Dream by Users takes place fully at the responsibility and risk of the Users.

Hunt Your Dream and its information providers reject any liability for any damage, direct and indirect, on whatever grounds, arising from or related to the use of application of information, products, or services which are offered through the Hunt Your Dream App, the www.huntyourdream.com website, or other website or sources referred to in/from Hunt Your Dream.

  1. Liability and indemnifications

    1. The Licensor does not accept any liability and responsibility for data posted by you, a third party or another User or saved via our Services and Additional Services. You indemnify us against any and all legal claims, complaints and damages that are related to a claim that you have vis-à-vis a third party. Your rights with regard to the HYD User Agreement are not affected by the aforementioned disclaimers if the legislation of the country where you reside, and applicable as a consequence of your use of our Services and Additional Services, does not permit this.
    2. Provided permitted by law, you declare to agree that we are indemnified against any and all complaints, charges, claims, damages, losses, costs, liabilities and expenses (including expenses for legal assistance) as a result of or in any way connected to: (a) your access to or use of our Services and Additional Services, your Content or your violation of these Terms and Conditions.
    3. We are not responsible and we do not accept liability for any damages that you or a third party incur due to or on account of the use of Hunt Your Dream and/or the (Additional) Services, also including - but not limited to: 1) direct or indirect damages in the broadest sense of the word; (2) loss of profit or revenue; (3) loss of data, loss of use, or immaterial damages as a result of: (a) your use of / access to our Services and Additional Services or the inability to use our Services and Additional Services; (b) the use of the Content of other Users or third parties on or via the Services.
    4. If we are, nonetheless, deemed to be liable for any damages then the said liability shall be limited to a maximum of € 100.00, or the amount that you paid to the Licensor during the past 12 months, depending on which of both amounts is higher.
    5. Th aforementioned limitations of liability are not applicable if imputable damages were caused by our gross negligence or intentional recklessness, or that of our employees. Should one of the aforementioned disclaimers, indemnifications or limitations of our liability not be permitted according to the legislation of your country then only the relevant disclaimer, indemnification or limitation of the liability shall not apply.
  2. Final provisions

    1. If you reside in the European Region then you can exclusively have your dispute or claim settled by a competent court in the Netherlands (where Dutch legislation is applicable to these Terms and Conditions), unless the legislation in the country where you reside prohibits this. Only in that case can you bring your dispute or claim to the cognisance of a competent court with jurisdiction in respect of your claim.
    2. Special arbitration provision for users in the United States or Canada.

The following provisions apply exclusively to Users in the United States and Canada. If you are a User in the United States or Canada, you and we accept to submit all disputes for binding arbitration, except for disputes related to intellectual property rights and disputes that can be brought before a small claims court. This means that you waive your right to have such disputes settled by a court or jury. This section also limits the period you have to file a claim, including the period you have to start arbitration proceedings, or, if permissible, judicial proceedings. Finally, you can exclusively file a complaint on behalf of yourself, and not on behalf of an official or other person, nor on behalf of a group of people. You waive your right to participate in or to file your dispute and have it settled as a collective claim, group arbitration, or a claim by representatives.

An ‘Excluded Dispute’ concerns the following: each dispute related to enforcing or violating your or our intellectual property rights (such as copyrights, trademarks, domains, logos, proprietary secrets, and patents). For the purpose of clarification and notwithstanding the above, disputes related to, arising from, or otherwise related to your privacy and publicity rights are not Excluded Disputes.

American Federal Arbitration Act. The American Federal Arbitration Act governs the interpretation and enforcement of this ‘Special arbitration provision for users in the United States or Canada’ section, including the question whether a dispute between you and Hunt Your Dream can be the subject of arbitration.

An arbitration agreement for Users residing in the United States or Canada. With respect to Users located in the United States or Canada, we and you both accept to waive the right to proceedings in front of a judge or jury for all Disputes, except for the Excluded Disputes. You and we accept that all disputes (except for the Excluded Disputes), including Disputes associated with, arising from, or otherwise related to your privacy and publicity rights, will be settled using final and binding arbitration. You and we accept not to combine any Disputes based on these Conditions that are subject to arbitration with a Dispute which does not qualify for arbitration in accordance with our Conditions.

The arbitration proceedings will be governed by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules that apply at the moment the arbitration is initiated, including the Optional Rules for Emergency Measures of Protection and the Supplementary Procedures for Consumer-Related Disputes (jointly referred to as the ‘AAA Conditions’). The arbitration proceedings will be chaired by one arbitrator selected in accordance with the AAA conditions. The AAA conditions, information about initiating a Dispute, and a description of the arbitration proceedings can be found at www.adr.org. The arbitrator will decide whether a Dispute will be settled by means of arbitration. The location of the arbitration and the allocation of compensation and costs for such arbitration proceedings will be determined in accordance with the AAA conditions.

Revocation procedure. You have the right to revoke your acceptance of arbitration (‘opt-out’). If you do so, neither you nor we can demand the other party to participate in arbitration proceedings. You must inform us in writing about this revocation within 30 days of the latest of the following dates: 1. the date on which you have accepted our Conditions for the first time, or

2. the date on which this arbitration provision becomes applicable to you. Use the following address to revoke your acceptance:

Indicate the following: 1. your name and address, 2. the mobile number linked to your account, and 3. a clear declaration that you wish to revoke your permission for arbitration in accordance with our Conditions.

Period for submitting a Claim. You and we accept that you and we must submit a Claim (including the initiation of arbitration proceedings) for each Dispute (except for the Excluded Disputes) within one year after the Dispute arose, or such Dispute will expire permanently. This means that if you or we fail to submit a Claim (including the initiation of arbitration proceedings) within one year after the Dispute arose, the Claim will be rejected because it has been submitted too late.

No collective claims, collective arbitration, or claims by representatives for Users located in the United States or Canada. You and we both accept that you and we, if you are a User located in the United States or Canada, can both file a Dispute vis-à-vis each other on behalf of yourself or us, and not on behalf of another person or legal entity or a group of persons. You and we both accept not to participate in a collective claim, collective arbitration, Disputes filed by a private advocate general, or in a representative capacity or in merged Disputes in which another person or legal entity is involved in relation to any Dispute.

Severability. If the ban on collective claims and other Disputes filed on behalf of third parties is considered unenforceable with respect to a Dispute, all provisions below the ‘Special arbitration provision for Users in the United States or Canada’ heading will be void with respect to this Dispute.

If you revoke your permission for arbitration, if your Dispute is an Excluded Dispute, or if the arbitration agreement is considered unenforceable, you accept that you will have your Dispute or claim exclusively settled by a competent court in the Netherlands (in which respect Dutch legislation will govern these Conditions), unless the legislation of the country in which you resides forbids this. You will only be able to file your dispute or claim with a court competent to hear your claim in this respect. If Dutch legislation does not apply based on the above, an alternative arbitration method may apply, provided this is permitted based on the regulations of your local Small Claims Court and you can file your Dispute with your local Small Claims Court, provided that the case is handled individually, not collectively.

    1. The HYD User Agreement can only be concluded by you as a natural person (and hence not by a business to which you are linked).
    2. We reserve all rights that are not expressly granted to you.
    3. We can change the HYD User Agreement, including the Privacy Policy. The latest HYD User Agreement can be found at https://www.huntyourdream.com/privacybeleid. Changes of the HYD User Agreement are announced at least two months in advance. If you are a consumer then you are, in case of a change of the HYD User Agreement, entitled to terminate it at the latest one month before the date of the entry into force of the new HYD User Agreement. You must communicate this by contacting our Support.
    4. You cannot transfer your rights or obligations pursuant to this HYD User Agreement without our consent. This prohibition has effect under property law.

 

 

PRIVACY POLICY

When it comes to the use of Hunt Your Dream, we realise all too well that you enter personal data. We therefore prioritise the security and protection of your personal data. You can read how we handle this within Hunt Your Dream in our Privacy Policy below. If you use our services then you share certain data with us. We are pleased to inform you what data we collect, what we do with them and what options you have to inspect, correct, update and erase your data.

  1. Foundation for processing

    1. Hunt Your Dream by Connecting Your Love is an application of Winning Quotations Only B.V., having its registered office in Arnhem (the Netherlands) and registered with the Chamber of Commerce under no. 27282051, and establishment no. 000017507294. Winning Quotations Only (‘we’) is responsible for the processing of your personal data.
    2. We process your personal data on the basis of certain statutory foundations for processing, including:
      1. Implementation of the HYD User Agreement. You conclude an agreement with us for the supply of the (Additional) Services. To this end we must process your personal data.
      2. Our justified interest. We use your data, for instance, to improve our Services and Additional Services (for instance to be able to show your personal Growth Topics and Moodboards).
      3. Consent. In certain situations we can expressly ask you for consent to use your data for certain purposes.
      4. Statutory obligation. It may happen that we are by law held to use, retain, isolate or erase your personal data.
  2. What data do we collect?

    1. To be able to supply our (Additional) Services to you, and to further optimise them and to better gear them to your needs, we process three types of personal data, namely the data with regard to: your account information, the Content to the extent that it regards personal data and your activity within our (Additional) Services.
  3. Data supplied by you on the basis of your Account

    1. If you want to use our (Additional) Services then you must first register by creating an Account with personal details, e.g. a user name plus password, an email address, a mobile telephone number, a profile photo, address details, your gender, your date of birth and the frequency for receiving push messages.
  4. Data that we process when you use our Services and Additional Services

    1. We collect data that you supply to us when you work with our Services and Additional Services. Below you can find the data that we collect when you use our Services and Additional Services.
      1. Support data. We collect data when you contact our Support Department. Before you send a request for support, we bring to your attention that you give consent to handling of your request for support by clicking send.
      2. Device details. We collect information about the hardware, software and the browser details of the devices that you use.
      3. Camera and images. To upload photos in your Journal and Moodboard we require details of the camera and the images on your device.
      4. User data and log files. We collect data about how you use our Services and Additional Services. For instance, how active you work with Hunt Your Dream.
      5. Content details. In respect of the Collective Part we collect the Content that you share with other Users. This Content is also made available to the said other Users. In respect of the Personal Part we collect the Content that you enter personally. The Content in the Personal Part is not shared with third parties, unless you gave consent to this. Because of the end-to-end encryption third parties cannot read your Content in the Personal Part. If you indicated this in your account details then we can use your Content in the Personal Part for anonymised (statistical) research, in order to inform the public and to improve the quality and your perception of Hunt Your Dream.
      6. Financial details. If so required for the payment of Hunt Your Dream Premium and/or In-App Purchases then we process your payment details, e.g. credit card or bank account details.

  5. How do we use data?

    1. We use your personal data to:
      1. supply our Services and Additional Services to you;
      2. continuously expand, improve and better gear our Services and Additional Services to you;
      3. monitor and improve the security of our Services and Additional Services;
      4. monitor and check the identity of Users in order to prevent unauthorised activities;
      5. check if the HYD User Agreement is complied with;
      6. generate statistics, signal trends, anticipate this and inform the public about it;
      7. show advertisements that are best in line with your profile;
      8. send you messages in which you can give your opinion about a certain question / topic;
      9. answer your requests for Support;
      10. share, at your request, data with third parties affiliated with us in order that they can serve you in the best way possible.
  6. Data that we share with third parties

    1. With third parties. We can share your data with, inter alios, the following third parties:
      1. With service providers, business partners, third parties for legal reasons (e.g. violation of terms and conditions pursuant to the HYD User Agreement), third parties in the context of a merger, financing or (full or partial) takeover of Hunt Your Dream.
      2. We can also share combined, anonymised Content with publishers, advertisers, interest groups, collectors of statistics, professional journals, the press.
    2. Integrated services of third parties. If you use services of third parties or services of third parties that were integrated with our Services and Additional Services then the said external third parties may receive data about what you share with them. We therefore advise you to read the Privacy Policy of the said third parties carefully (in advance).
  7. How long do we retain your data?

    1. Personal data with regard to the Personal Part are retained for the full duration of your Account, unless you personally remove them in Hunt Your Dream, or we remove these personal data, for instance because you violated the HYD User Agreement.
    2. Personal data with regard to the Collective Part are also retained for the full duration of your Account. However, when your Account is closed, your Content (which may consist of personal data) remains available in the Collective Part.
    3. Personal data with regard to a request for Support submitted by you are retained for a maximum of one month after your request for Support has been answered.
    4. Visual material that you save in your Moodboards are only processed locally on your device. Hence, we do not retain this kind of visual material.
    5. We basically retain your account details, e.g. your name, telephone number, email address, for the duration of your Account.
    6. In derogation from the aforementioned provisions, it is noted that we may by law be held to retain your personal data for, inter alia, tax and administrative obligations and obligations under criminal law. To the extent that the said obligation prescribes a longer retention period than explained above, we retain your personal data for the period that is prescribed. We may also receive a legal request to retain certain data, the same conditions are applicable to the said request.
  8. How can you manage your data?

    1. If you want to change, protect or erase your data then you can do this as follows:
      1. Download your account information. You can regularly consult and adjust most of the account details. In the course of 2020 you can download your account information via the app. It may be that we ask you to verify your identity. As the occasion arises, we can refuse your request to consult or download your account information.
      2. Process your answers. You have the possibility of processing (almost all) your answers.
      3. Erasing your account information. It goes without saying that we look forward to a life-long cooperation, however this does not alter the fact that you can remove your Account for any reason whatsoever. You are free to erase certain Content in Hunt Your Dream, e.g. photos and your answers to your personal Growth Topics.
      4. Adjusting your consent to the anonymised collection of data of your personal Growth Topics. As noted, we use your Content, if you gave consent to this, for anonymised (statistical) research. You can easily revoke your consent to this via the Settings menu in Hunt Your Dream.
      5. Adjusting your consent to participate in our online surveys. We periodically submit a question to you in connection with our online surveys. If you do not want to receive questions then you can easily change your preference in the Settings menu in Hunt Your Dream.
      6. Adjusting your preferences for partner content. Of course we prefer only showing your advertorials and other Content that you can benefit from. In Hunt Your Dream you can easily change your advertising preferences in the Settings menu.
  9. Security

    1. We set up Hunt Your Dream with modern security measures. In this respect we took appropriate technical and organisational measures to properly secure the processing of your personal data. For instance, we use a secured cloud platform, end-to-end encryption and access to Hunt Your Dream is facilitated by a ‘token system’.
    2. We prioritise security, but you can (and must) also contribute to this personally. On the basis of this HYD User Agreement you agree with the following conditions. Generally speaking, it is prohibited to act in violation with this HYD User Agreement, more specifically it is noted that it is prohibited to:
      1. use our (Additional) Services for illegal and criminal purposes;
      2. upload viruses or other malicious software (malware) to thus infect and undermine Hunt Your Dream;
      3. illegally obtain, in any way whatsoever (e.g. via spiders, robots, scrapers), access to our (Additional) Services and/or the data of other Users;
      4. use the User Account of a third party User without consent of the said person;
      5. in any way whatsoever hinder the enjoyment of other Users or the organisation of Hunt Your Dream;
      6. scan and test our Services, networks, security mechanisms and systems;
      7. develop applications that use or do something with the Content of our Services or (personal) data of the Users.
    3. If you suspect that a third party has unauthorised access to your Account or that a third party acts in violation of the HYD User Agreement then we request you to contact our Support immediately.
  10. How can you object?

    1. The General Data Protection Regulation entitles you to, inter alia, information, correction and erasure of your data. With regard to most of the data within Hunt Your Dreams it is noted that you can easily adjust or erase them in Hunt Your Dream yourself. If you want to object to the processing or your personal data, or if you have other privacy-related questions, then you can contact us via support@huntyourdream.com.

 

  1. Do you have a complaint? 

    1. We advocate solving, where possible, the things with you but you are free to submit a complaint to the supervisory authority in your country.

  3. Minimum age

    1. Our services are meant for people aged 16 and over. As the occasion arises, we may require that your parents give consent before we collect and use your data.
  4. Conditions of a third party

    1. If you purchase a service from a third party that is made accessible through our Services and Additional Services then not just our terms and conditions, but also the terms and conditions of the said third party are applicable. Hunt Your Dream is not liable for the terms and conditions of a third party.
  5. Revision of this Privacy Policy

    1. We may change this Privacy Policy from time to time. We do, in any case, announce these changes via our website: huntyourdream.com.
  6. Copyright HYD User Agreement

    1. The content of the entire HYD User Agreement (including the Privacy Policy) is subject to copyright, the said copyright is vested in the Licensor. It is not allowed to copy the content of this HYD User Agreement, either in whole or in part, unless with our express written consent.
